Justice Mohammed Garba Umar of the Federal High Court in Abuja has dismissed the no-case submission filed by activist, Omoyele Sowore, in the cyberbullying case instituted against him by the Department of State Services (DSS).
The DSS had arraigned Sowore on charges of allegedly cyberbullying President Bola Ahmed Tinubu.
The agency accused Sowore of referring to Tinubu as a “criminal” on his Twitter handle.
Delivering ruling on Friday, Justice Umar held that the prosecution had successfully linked the defendant to the alleged offences and established a prima facie case against him.
The court subsequently dismissed the no-case submission and ordered Sowore to enter his defence in the two-count charge.
Sowore had urged the court to discharge and acquit him, arguing that the prosecution failed to establish sufficient evidence to warrant him being called upon to defend himself.
However, Justice Umar ruled that the evidence presented by the DSS was sufficient for the trial to proceed to the defence stage.
